Quebec City, Quebec — Law firm BGA has filed a motion in Quebec’s Superior Court seeking authorization to bring a class-action lawsuit against car dealers in the province for overcharging drivers by an alleged $54 million in fees.
According to online reports, extended warranties that were offered to new car buyers were not exempt from combined GST-HST as they should have been, and so, customers were overcharged by 6.56 percent.
As a result, the corresponding lawsuit covers drivers who purchased Ford Protect; Extra Care Protection from Toyota; Global Protection from Honda; Gold or Platinum products from Nissan; and Diamond Plan products from Mitsubishi.
Originally filed on January 25, 2025 by Benoît Gamache in the Montreal Court District, the class-action lawsuit further claims that tens to thousands of Quebec drivers have been affected for between $50 to $150 each.
The lawsuit is being represented by two plaintiffs, Sandra Dalpé-Palerme and Richard Gagné.
If authorized by a Superior Court Judge, the class-action lawsuit, Class Action No. 500-06-001356-258 intends to include all Quebec residents who paid GST and QST on the price of a protection plan sold by the Defendants when purchasing or leasing a vehicle.
