Richmond, British Columbia – The B.C. Civil Resolution Tribunal has ruled that a local resident who punched another person’s vehicle must pay $300 in deductibles, after a spat which left another driver with a dented vehicle.
According to an article by the Richmond News, this ruling follows an incident on May. 4, 2022 when William Cornish parked his truck next to Donald MacLeod, hitting MacLeod’s car while opening the door.
While this left no damage, an argument ensued, with MacLeod hitting Cornish’s vehicle. Cornish retaliated by hitting MacLeod’s car, leaving a dent and a $300 deductible on MacLeod’s hands.
While Cornish apologized, he argued that MacLeod was responsible for paying the repair costs given his involvement in escalating the dispute. He later told MacLeod that ICBC would cover dent repairs, which came to an estimate of approximately $1,200.
The tribunal ultimately ruled that Cornish and MacLoad had implicitly reached a settlement agreement, binding Cornish to a contract where he would bear responsibility for repairs.
